These Terms of Service (“Terms”) govern your access to and use of the websites, online store, and related services offered by Pike Street Nuts (also known as Pike Place Nuts) (“Pike Street Nuts,” “we,” “us,” or “our”). By visiting our site, placing an order, creating an account, or interacting with us in any way, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use our site or services.

Plain-English note: This document is meant to be clear and practical for a small U.S. food business. It is not legal advice. State laws may vary. If you have questions about your rights, consult an attorney.

1) Who we are & how to contact us

2) Eligibility & your account

  • You must be at least 18 (or the age of majority in your state) to purchase. If you are under 18, you may only use the site with the involvement of a parent or legal guardian.

  • You are responsible for activity on your account and for keeping your login secure. Tell us right away if you suspect unauthorized use.

3) Online store; product information

  • Food products. We sell candied and roasted nuts and related items. Ingredients are listed on product pages or packaging.

  • Allergen notice. Our products contain peanuts and/or tree nuts and are produced in a facility that handles both. If you have a severe allergy, our products are not suitable for you.

  • Dietary claims. We strive to ensure all flavors are vegan and gluten-free as represented; however, always check the ingredient list for the current batch and contact us with questions.

  • Availability. Flavors, pricing, and sizes may change without notice and may be limited or out of stock.

  • Accuracy. We try hard to post accurate photos, prices, and descriptions, but errors can occur. We may correct any errors and cancel or refuse orders placed with incorrect information.

4) Orders, pricing, taxes & promotions

  • Offer & acceptance. Your order is an offer to buy; we accept when we charge your payment method and send a confirmation. We may refuse or cancel any order (e.g., suspected fraud, pricing error, limited stock).

  • Prices. Prices are shown in U.S. dollars and exclude applicable taxes and shipping unless stated. You are responsible for taxes and shipping shown at checkout.

  • Promotions & codes. Promotions may be limited, subject to additional terms, and can be modified or ended at any time. One promotion per order unless explicitly allowed.

  • Resale. Our products are for personal use and gifts. No resale or wholesale without our prior written consent.

5) Payment & billing

  • Processors. We use third-party payment processors and digital wallets. By submitting a payment, you agree to their terms.

  • Cards. We do not receive or store full card numbers.

  • Verification. We may request additional information to verify identity, prevent fraud, or comply with law. Orders may be canceled if verification cannot be completed.

6) Shipping, risk of loss & delivery

  • Timing. Most orders ship within a few business days. Seasonal schedules or delays will be posted on the site banner when applicable.

  • Title & risk. Title and risk of loss pass to you upon carrier’s acceptance of the shipment. Please track your package and bring it inside promptly (especially in hot weather).

  • Carrier issues. Once a package is in the carrier’s hands, delivery times are estimates. We’re not liable for delays outside our control, but we’ll help you follow up with the carrier.

  • Address problems. You’re responsible for entering an accurate shipping address. We’re not responsible for packages lost due to an incorrect address you provide.

7) Warm-weather & perishable guidance

Nuts generally ship well, but heat can impact some coatings. During unusual heat waves, we may adjust shipping schedules. Please retrieve packages quickly after delivery. Contact us if something arrives in poor condition.

8) Returns, refunds & replacements

  • Food safety. We can’t accept returns of opened food products.

  • Quality guarantee. If your order arrives damaged, incorrect, or doesn’t meet expectations, email pikeplacenuts@gmail.com within 7 days of delivery with your order number and a photo. We’ll repair, replace, credit, or refund as appropriate.

  • Refund method. Approved refunds are issued to the original payment method. Bank processing times vary.

9) Gift & group orders

We’re happy to help with corporate and event gifting. You’re responsible for accurate recipient names/addresses. For multi-address shipments, we may request a spreadsheet in our preferred format.

10) Acceptable use

You agree not to:

  • Violate laws or regulations;

  • Interfere with site security or attempt to access areas you’re not authorized to use;

  • Scrape, crawl, or use automated means to access the site except for indexing by search engines;

  • Use the site to harass, defraud, or harm others;

  • Use our intellectual property (defined below) without permission.

11) Reviews, user content & feedback

If you submit reviews, messages, photos, or other content (“User Content”):

  • You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your User Content in connection with our business (e.g., on our site, emails, or social channels).

  • You represent you own the content and it doesn’t infringe others’ rights or include personal data you don’t want public.

  • We may edit or remove User Content at our discretion.

DMCA: If you believe material on our site infringes your copyright, email pikeplacenuts@gmail.com with: (a) your contact info; (b) a description of the work; (c) the URL of the allegedly infringing material; (d) a statement, under penalty of perjury, that you’re authorized and that the complaint is accurate; and (e) your signature.

12) Intellectual property

All content on the site—including text, graphics, logos, product names, recipes (not publicly disclosed), and design elements—is owned by us or our licensors and protected by U.S. and international laws. You may not reproduce, distribute, modify, or create derivative works without our written consent. All trademarks are the property of their respective owners.

13) Third-party services & links

Our site may link to third-party websites or use third-party services (e.g., payment, analytics). We don’t control those services and are not responsible for their content or practices. Your use of them is at your own risk and subject to their terms and policies.

14) Communications & E-Sign consent

By placing an order or contacting us, you consent to receive transactional emails (order confirmations, shipping updates, support replies). Marketing emails require opt-in; you can unsubscribe anytime. You agree that electronic records and signatures have the same force and effect as paper.

15) Warranties & disclaimers

  • Food quality. We aim for consistent, fresh flavor. Individual tastes vary.

  • AS IS. THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

  • No guarantee of uninterrupted service. We do not warrant the site will be error-free or uninterrupted.

Some states don’t allow limitations on implied warranties, so some disclaimers may not apply to you.

16) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIKE STREET NUTS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, OR DATA; OR COST OF SUBSTITUTE GOODS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ORDER AT ISSUE.

Some states don’t allow certain limitations; you may have additional rights.

17) Indemnification

You agree to defend, indemnify, and hold harmless Pike Street Nuts and our owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your User Content, or your misuse of the site or products.

18) Dispute resolution; arbitration & class-action waiver

Please read this section carefully. It affects your rights.

  • Good-faith resolution. Contact us first at pikeplacenuts@gmail.com; most issues can be resolved quickly.

  • Small claims court option. Either party may bring an individual action in small claims court in Seattle, Washington (or your county of residence, if allowed) instead of arbitration.

  • Binding arbitration. Except for small-claims matters and injunctive relief for IP misuse, any dispute, claim, or controversy arising out of or relating to these Terms or our products/services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. One arbitrator. Location: Seattle, Washington, or video/telephone if the arbitrator permits.

  • Class-action waiver. You and we agree to bring claims only in an individual capacity, not as a class member or representative. The arbitrator may not consolidate claims.

  • Opt-out. You may opt out of arbitration and the class-action waiver by emailing pikeplacenuts@gmail.com with subject line “Arbitration Opt-Out” within 30 days of your first use of the site after this policy’s effective date. Include your name, email, and a statement that you wish to opt out.

  • Governing rules & judgment. The arbitrator’s award may be entered in any court with jurisdiction.

19) Governing law & venue

These Terms are governed by the laws of the State of Washington, without regard to its conflicts of laws rules, and by applicable U.S. federal law. Subject to the arbitration clause above, the exclusive venue for any non-arbitrable claim is the state or federal courts located in King County, Washington.

20) Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., extreme weather, fires, floods, labor disputes, war, pandemic, carrier issues, acts of government, power/internet outages).

21) Changes to the site or these Terms

We may update the site, products, pricing, or these Terms at any time. If we make material changes to the Terms, we’ll update the effective date and may post a notice on the site. Your continued use after changes means you accept the updated Terms.

22) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

23) Severability; no waiver; entire agreement

If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with any policies referenced (e.g., Privacy Policy, Shipping & Returns), are the entire agreement between you and us regarding the site and services.
